Sexual Offenses Act: Section 1

What is a sexual offence? What are the consequences according to the Kenyan Law? These are some of the questions I will break down using the sexual offences act 2006, revised in 2014.

Often times we find ourselves in either side of law without knowing what it really entails. As a common mwananchi, I am curious to know about this law that should protect me.

The act contains 49 sections but here are some of the few in no particular order:

  • Rape
  • Test of relationship.
  • Test of relationship.
  • Attempted rape
  • Sexual assault
  • Deliberate transmission of HIV or any other life-threatening sexually transmitted
  • Consent
  • Sexual relationships which pre-date position of authority or trust.
  • Incest by female persons.
  • Compelled or induced indecent acts
  • etc.

An Act of Parliament to make provision about sexual offences,  their definition, prevention and the protection of all persons from harm from unlawful sexual acts, and for connected purposes
